These Terms and Conditions (hereinafter referred to as “Terms”) of the company Technology Labs S.R.L. (hereinafter referred to as “Seller”) shall apply to all contracts concluded between a consumer (hereinafter referred to as “Buyer”) and the Seller relating to all goods and/or services presented in the Seller’s online shop (hereinafter referred to as “Website”).

By using the Website, ordering or purchasing goods and/or services, the Buyer agrees to be bound by the Terms.

The Buyer is obliged to provide current, complete and accurate contact and delivery information necessary for order fulfilment.

Age of Consent

By placing an order on our website, you declare that you are of the appropriate legal age to purchase the items. If we discover that you are not of legal age to order certain goods, we reserve the right to cancel your order.

Contract Formation

All orders made by you through the Website are subject to acceptance and availability. We may choose not to accept your order for any reason.

Prices of products are correct at the time of entering information, however, we reserve the right to change prices without prior notice (although we will inform you if any such price change affects your order).

Only when LoveLab accepts the Order by sending you a confirmation email that your order has been dispatched will a contract have been created between yourself and LoveLab.

Proper Use of Products

All products sold by LoveLab are intended for personal use only and should be used in accordance with their intended purpose as described in the product descriptions and instructions. Customers are solely responsible for ensuring that they use the products safely, responsibly, and in compliance with all applicable laws and regulations.

Liability Disclaimer

LoveLab shall not be held liable for any misuse, improper use, or unintended use of our products. This includes, but is not limited to:

  • Any physical injury, discomfort, or health issues resulting from improper use of the products.

  • Any damage caused by the use of the products in a manner inconsistent with their intended purpose.

  • Any legal consequences arising from the use of the products in violation of local, state, or federal laws.

By purchasing from LoveLab, you acknowledge and agree that you assume full responsibility for any risks associated with the use of our products.

Delivery

The products will be delivered by courier. At the customer's request, the desired delivery method can be used, if this is possible, with the additional expenses highlighted in the invoice.
The ordered sex-shop products will be packed and will be marked with the sender's data in such a way as not to reveal their contents.
As a rule, the products will leave our warehouse within 24 hours if they are in stock. Any claims for compensation for damages caused by exceeding the delivery deadline will not be accepted.
At the time of delivery, the customer will be informed that the products have left our warehouse and are now in the custody of the courier.

Return Policy

The Buyer has the right to notify the seller in writing that he gives up the purchase, without penalties and without citing a reason, within the legal term of 14 days after delivery. The only costs that are borne by the consumer are the direct costs of returning the products. The returned goods must not be used and damaged. Some types of goods can be returned in original unopened/sealed packaging only – for hygienic reasons (erotic toys, cosmetics) or copyright reasons (DVDs, books). The refund will be processed after receipt and inspection of the returned goods by the Seller.

According to Art. 16 of GEO 34/2014 regarding consumer rights, we reserve the right to refuse returns for:
• products made according to the specifications presented by the consumer or clearly customized; (Art. 16 letter C)
• products that cannot be returned for health protection or hygiene reasons and that have been unsealed/used by the consumer. (Art. 16 letter e)
• video cassettes, DVDs, CDs and software packages if they have been unsealed. (Art. 16 letter i)
In the case of products in the form of sets or assortments, they will be returned in their entirety, even if the complaint only refers to a single item from the set or assortment.

Transport damage

If, unfortunately, the received products turn out to have damage due to transport, the customer is obliged to claim these damages at the collection service (post office)/courier.

Faulty Products

If the requested products prove to have technical or manufacturing defects, the customer is obliged to contact EroticArts.ro within 14 days of receiving them.
Orders for which no complaint has been made by the client, within this term, are automatically considered fully accepted by the client.
The defective products will be sent by the customer within the same period, together with the original invoice, to the address specified on the parcel to the sender. In this case, EroticArts.ro undertakes to replace the products that are the subject of the complaint, in the shortest possible time and to bear all the expenses deriving from these actions.
If EroticArts.ro is unable to replace the products, the customer will be refunded their value.

Sharing Your Personal Information

We may share your personal information with third parties to help us use your personal information, as described above. For example, we use Shopify to power our online store. You can read more about how Shopify uses your personal information here: https://www.shopify.com/legal/privacy. We may also share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by a force majeure event. A force majeure event which means any act or event beyond our reasonable control such as, but not limited to, strikes or industrial action by third parties, civil commotion, riot, invasion, terrorist attacks, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster (“Event”).

If an Event takes place that affects the performance of our obligations under a contract:

(a) we will contact you as soon as reasonably possible to notify you; and

(b) our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event. Where the Event affects our delivery of products to you, we will arrange a new delivery date with you after the Event is over.

You may cancel a contract affected by an Event . To cancel please contact our customer services team. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.

External Websites

As a convenience for our customers, our website includes links to other websites or material which are beyond our control. EroticArts is not responsible for the content of external websites linked on the Websites.

The Seller strives to provide accurate information about the products sold. However, the Seller is not responsible if any information is not accurate, complete or current. The product descriptions, parameters and images on the Website are provided for general information only.

All prices on the Website include VAT, where applicable.

The Seller provides information on available shipping and payment options on the Website.
